| 1.
Typographical Errors: We endeavor to provide accurate and up-to-date information on the products and services listed on our Web Sites, however, as Flatlander Racing cannot verify all information from all manufacturers and providers and as errors in gathering and publishing such information may occur, Flatlander Racing does not warrant that the product and service listings are or will be always accurate, complete or current and Flatlander Racing shall not be liable or responsible as a result of any errors therein. Therefore, Flatlander Racing reserves the right to refuse or cancel any orders placed for products listed at the incorrect price and shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase, and your order has been canceled, Flatlander Racing shall immediately issue a refund to you in the amount of the incorrect price. All prices on this site are subject to change without notice. Flatlander Racing disclaims responsibility for any printing or typographical errors, and does not guarantee that all information is accurate. Consumer Responsibility: Flatlander Racing in its attempt to help with Technical information uses its best educated judgment. In cases of compression, the customer or his mechanic shop must check for the proper parts supplied. Failure to do so will in no way make Flatlander Racing responsible for pistons that have been installed. In any case where an assembly has been balanced, Flatlander will only be responsible up to the cost of $100. Custom Parts/Special Orders: Please see our Custom/Special Orders policy for consumer responsibility for custom parts & special orders. |

Security: We use a secure online ordering form so that your personal information is secure. Whether you place your order Online, by US Mail, Fax, or Telephone, we will never use your information for anything other than your purchase, nor will we release the information to any outside sources under any circumstances. |

| 4.
Privacy: We do not collect personal information without your knowledge. We only collect needed personal information with regards to any order you choose to place with us. Personal information will not be sold, disclosed, or shared with 3rd parties unless we need to drop ship your order directly from the manufacturer. In that case the manufacturer will be given your name and shipping address so that they may ship your order to you. Please contact us if you have questions pertaining to our Privacy Policy. |

| 5. Payment Options: | |||

A. Credit Cards:
We accept MasterCard, Visa, or Discover. Make sure to enter your complete account number and expiration date. There is no surcharge for using your credit card to make purchases. Your credit card will be authorized upon processing your order, and will be billed prior to shipment. |

B. Money Orders & Checks: If you phone or mail your order and
use a money order, bank check or certified check for payment, your order will be shipped within 24 hours upon receipt of your payment. Please do not send cash. If you send a personal check to us, we will hold your order for 10 days until it has cleared the bank. Your item will then be shipped. Flatlander Racing cannot guarantee the availability of a product by the time funds clear or payment is received. Please make out all Checks/Money Orders to "Flatlander Racing" Returned Checks: We will charge a $30.00 fee on all returned checks. |

| 6. Ordering: | |||
|
A. Online: Online orders are processed within 24 business
hours. Please allow 5-7 business days for UPS Ground Shipping. Should any questions arise with your online order, we will contact you by email at the address you used to place your order. |

B. By Postal Mail: We accept orders via US Mail. You must
call us first to get a grand total for your order including shipping before you mail us your order. You will need to include the following with your Mail Order with your payment: Part #(s) Qty. | 7. International Orders: | |||
|
A. General Info: Due to the increased amount of security
issues, as of August 20, 2001 we may not be able to process Credit Card payments from some countries outside of the US and Canada. A minimum amount of $100 is required for all overseas purchases (including Canada). |

B. Shipping: All International shipments will be made via
US Postal Service Air. Insurance will be included with ALL orders - no exceptions. Int'l Orders can NOT be shipped free or as "gifts" |

Fees: All Int'l orders will be charged a $25 processing fee. (Int'l Credit Cards will be charged the $25 processing fee even if items are shipped within the USA.) All Canadian orders will be charged a $20.00 processing fee (fees cover local P.O. and runners fees) Warehouse Transfer Fees may apply to all non-US orders. (Not all our warehouses have the ability to ship overseas. Depending on the parts, we may have to transfer your order from one warehouse to another in order to ship to an overseas address. If this happens, you may be charged a Transfer Fee) |

Back Orders: Occasionally a backorder will occur, even with our large
inventory. In situations like this,
we make every effort to cross-reference the part to a comparable
manufacturer's line. If cross-referencing is not an option and you have to
wait for a part, we will leave the option up to you if you want a refund. Note: Due to variations in manufacturers shipping times, active backorders are kept open for a maximum of 45 days. If we haven't received the item from the manufacturer after this time, the backorder will be cancelled and we will call you, at which time you may re-order or substitute a similar item. It is very important to us that you are completely satisfied with your entire order, every time. |

Custom/Special Orders: Custom & Special Orders can not be returned.
(All items not in stock and/or are created unique for the customer are
considered to be special orders). The customer and/or mechanic must check
for the proper parts supplied. Failure to do so will in no way make
Flatlander Racing responsible for any damage to parts or engine that have
been installed. Custom Parts CANNOT be cancelled once they have been started in production under any circumstances! (To cancel custom parts before production, you must first call us at (603) 378-0090 and ask to speak with a manager to request a Custom Parts Cancellation Code. Please keep a copy of your Custom Parts Cancellation Code and Manager's name for your records.) Custom Motors are non-refundable for any reason. Time to build custom motors will vary depending on type of motor and any complications that may arise (motors taking 4-6 months to complete are not uncommon). No assembly or shop costs are covered for any installation or removing of engine parts. Due to the intended usage of custom motors & parts, all products are sold without any expressed, unexpressed, implied, un-implied warranty under any circumstances. We assume no responsibility in any shape, form or manor. Any action taken against Flatlander Racing or its subsidiary companies, is taken at the total and complete expense of the purchaser. All motors are intended for off highway total risk applications. All parts are under warrantee only as stated by the manufacturer. Customer assumes all costs and expenses for any legal action taken by said person. |

10.
Shipping: All orders are shipped via UPS ground (5-7 business days),
within the continental USA (unless customer specifies faster shipping -
see options below).

| 11.
Returns: When making a return, please follow the Returns Policy below
to make this process as efficient as possible for you as well as for us.
*** DO NOT RETURN ANY PACKAGES WITHOUT CONTACTING US FIRST ***
Some items which are drop-shipped directly from a manufacturer may be returned directly to its origin. Again, the item must be in its original packaging and you must call Flatlander Racing before you send it back so that we can arrange for the return. A 15% restocking fee will be accessed upon the item(s) being returned only. |

| 12. Refunds & Cancellations: All refunds for orders paid with Credit Cards will be credited to the same card in which you placed the original order with. Any cancellation that has been placed and paid via Credit Card is subject to a 4% NON-REFUNDABLE charge. Orders paid using money orders, bank checks, personal checks or wire transfers will be refunded by a business check. | |||
